Two cyclists have received compensation after being involved in road accidents that were the fault of the motorist in each case.
Rebecca Thompson was out training with five other cyclists when she pulled out to overtake a parked car. As she did so, the driver pulled out without looking and Ms Thompson was thrown from her bicycle. The fall knocked her unconscious and she suffered grazes to her knee, chin and elbow.
Liability was admitted by the motorist's insurers and Ms Thompson received compensation both for her injuries and the damage to her bicycle.
In the second incident, Dr Philip Marren was on his way to meet up with fellow cycling club members when a motorist turned right across his path. Although Dr Marren took evasive action, he collided with the vehicle and was knocked off his bicycle. He suffered a series of soft tissue injuries to his knee, rib cage and face and his cycling equipment was damaged.
At the scene of the accident the motorist admitted that he had been driving with reduced visibility as his windscreen was iced up. The police report also suggested that the motorist had been negligent. Even so, the driver’s insurers at first refused to admit liability for the accident.
Dr Marren underwent private physiotherapy treatment in order to aid his recovery and after medical evidence of his injuries was produced, the insurers did agree to settle his claim.
Sports and recreational activities can pose risks. If you have been involved in an accident resulting from someone else's negligence, you could be entitled to compensation.
