£3,500 Compensation for Low Speed Collision
A Liverpool woman has been awarded £3,500 for a whiplash injury sustained when her taxi was 'bumped' by another car.
Caroline Spencer was a passenger in the taxi when it was struck from behind as it was about make a right turn. The taxi driver gave evidence in court that the accident had happened at less than 5 mph. Whilst there had been a noise when the collision occurred, it could not be described as a 'thump'.
There was only very minor damage to the number plate of the car that hit the taxi and the court heard that the effect of the impact would have been the same as going over a pothole.
Even though the accident occurred at low speed, Mrs Spencer suffered a whiplash injury to her neck. Over the next few days she developed a stiff neck along with a tingling sensation in her left arm. Mrs Spencer recovered quickly, however, and was able to go back to work immediately.
The case has attracted comment, being seen as evidence that a 'compensation culture' is developing in Scotland. However, it is also true that people are more aware of their right to make a claim than they were hitherto.
