A nursing assistant who fell down a stairway on her way to get her car out of the garage has been awarded £108,750 in compensation.
Agnes Wilson, who was 57 at the time of the accident, was on her way to work when the accident happened. She was walking down the stairway near her high-rise home when one of the steps wobbled and she fell.
Mrs Wilson sustained a broken arm and a serious bump on her head. When she woke up in the accident and emergency department of Glasgow Royal Infirmary, she was unable to recall the incident.
The court heard that a couple had passed Mrs Wilson as she was approaching the stairs. They then heard her scream. James Saunders, a neighbour of Mrs Wilson, gave evidence that he had complained to Glasgow City Council about loose steps on a previous occasion. The Council, meanwhile, maintained that there was no problem with the steps and Mrs Wilson should have been more careful.
The judge, however, accepted Mr Saunders' evidence and found the Council liable.
Before the case was heard, a provisional compensation figure of £145,000 had been agreed in the event that Mrs Wilson won her claim. This sum was reduced by 25 per cent, to £108,750, as the judge found Mrs Wilson to be partly responsible for the accident.
